This seminar will consider the interrelationship between International law, EU law and Constitutional Law before national Courts.  The following Topics will be considered:

  • Different sources of law - overlapping or conflicting laws
  • Standard and burden of proof in case-law of the Court of Justice of the EU
  • Binding status of the Charter of Fundamental Rights - Varying standards of protection by different legal instruments
  • Interpreting the EU Treaties - Reconciling competing objectives
  • Potential Conflicts between International Law, EU Law, Constitutional law (Recent case-law of the Supreme and Constitutional Courts of Member States)

Key-Note Speaker: Professor Miguel Maduro

Professor Maduro is a Professor of EU law at the European Univesity Institute, Florence. As Advocate General at the Court of Justice, he delivered a number of ground-breaking Opinion in cases such as:

  • Metock - Union Citizenship - Freedom of Movement
  • Commission v. IrelandCase C-459/03 on Nuclear Reprocessing Plant dispute and the jurisdicition of the United Nations Tribunal of the Law of the Sea
  • Kadi and Al Barakaat International Foundation v. Council and Commission Joined Cases C-402/05 P and C‑415/05 P on asset-freezing
  •  FIAMM v. Council and Commission Joined Cases C-120/06 P and C-121/06 P on the extra-contractual liability of the Union 

The seminar will take place in the Distillery Building, Church Street, Dublin 7 from 6pm to 8pm. The registration fee for this event is €30 for ICEL members and €60 for non-members.
